Terms of Use, Cancellations and Returns

1. Introduction

ChupiTales Books helps children and families create personalized adventures. These terms govern use of the website and purchases of personalized products. By accessing the site, you agree to these Terms and our Privacy Policy.

2. Business Information

ChupiTales Books is operated by Bentata Consulting & Management LLC, registered in Florida. All payments and receipts are processed through this entity.

3. Products and Personalization

We offer personalized children's books with custom text and photos. Customers are solely responsible for the accuracy of the information they provide. We reserve the right to decline orders with inappropriate content, and customer errors are non-refundable.

4. Orders, Payments, and Receipts

Pricing is in U.S. dollars. Payments are processed through Stripe. Once submitted, orders enter production automatically and cannot be canceled or modified. Digital receipts are sent to the email address provided.

5. Shipping and Delivery

Professional printing partners in the U.S. manufacture and ship products via third-party carriers (UPS, FedEx). We are not responsible for delays, damages, or losses caused by shipping carriers. Estimated delivery times are not guaranteed.

Different items in an order may be produced and shipped by different printing partners. When an order contains both books and store merchandise (or multiple merchandise items), the items may ship separately and arrive at different times, each with its own tracking. Separate deliveries within one order are normal and are not grounds for a claim of a missing or incomplete order while shipments are still in transit.

6. Replacements, Refunds, and Cancellations

Sales are final and non-refundable. Replacements are offered only for manufacturing defects caused by us or our partners. Customers must request replacements within 14 days with supporting photos and documentation. Errors caused by the customer are ineligible for replacement.

Because items may be produced by different printing partners, cancellations (where available) apply per item, not per order: an eligible item may be canceled while other items of the same order have already entered production and will still be produced, charged, and shipped. Store merchandise enters production upon payment and cannot be canceled or modified after checkout.

7. Gift Credits

Gift credits are a form of store credit redeemable only toward personalized products on this website. One credit equals one U.S. dollar of value. A gift credit is delivered electronically as a redeemable code and is a bearer instrument – anyone in possession of the code may redeem it, so it should be safeguarded like cash.

Gift credits are non-refundable and have no cash value, and cannot be redeemed for cash except where required by law. A gift credit is applied to an order in place of any other promotional code (the two cannot be combined), and any unused balance remains on the code until it is exhausted. Gift credits are valid for five (5) years from the date of issuance.

Where we offer a remedy or a refund as store credit, that credit is issued and governed under this section. We may deactivate a gift credit that was issued in error, or that is obtained or used fraudulently.

8. Referral Program

Customers may receive a personal referral code to share with others. A referred customer receives a percentage discount off the lowest-priced book in their first qualifying order, and the referring customer earns store credits based on orders the referred customer pays for within the program's attribution window. Referral credits are store credit governed by the Gift Credits section above. Current percentages and window are shown on the Refer Friends page and may change at any time.

Self-referral is prohibited: a code cannot be applied to an order by, or for the benefit of, the code's owner. Attribution follows the first code a customer uses. We may modify, suspend, or terminate the referral program at any time, and may void attributions, discounts, or credits obtained through fraud or abuse; credits already earned in good faith remain redeemable.

As an exception to the Gift Credits no-cash-redemption rule, referral credits (and only referral credits - purchased or gifted credits are excluded) may be withdrawn as a cash payout to a PayPal account, subject to the minimum amount and processing fee shown on the Refer Friends page. The credit balance is deducted when a payout is requested; payouts are processed manually within a few business days. If we reject a payout request, the deducted credits are returned to the balance. Payout minimums, fees, and availability may change at any time.

9. Intellectual Property

All website content is protected by copyright law. We own all rights to AI-generated illustrations and text. Books are for private, personal, and reasonable use only. Commercial use, resale, or public distribution is prohibited without written permission.

10. User Conduct and Upload Rules

Users uploading images or text must have legal rights to the content, ensure it does not infringe others' rights, and confirm it is not offensive or illegal. We reserve the right to refuse any order and grant only a limited license for fulfillment purposes.

11. Disclaimer of Warranties

Products are provided "as is" and "as available" with no express or implied warranties. Minor color or print variations are not considered defects.

12. Limitation of Liability

We are not liable for indirect, incidental, special, or consequential damages. Liability is limited to the amount paid for the specific product in question.

13. Governing Law and Jurisdiction

These Terms are governed by Florida law. Disputes must be brought before courts in Broward County, Florida.

14. Changes to These Terms

We may update these terms with revised effective dates. Continued use of the site indicates agreement with any updates.
